1. INTRODUCTORY PROVISIONS
1.1. These General Terms for Sharing "Avant2Go" Electric Vehicles (hereinafter: General Terms) apply to all relationships arising from the Membership Agreement for Sharing "Avant2Go" Electric Vehicles (hereinafter: Membership Agreement), concluded between the Service Provider, AVANT CAR DOO Skopje, with its registered office at 11th October St. No. 2, Centar, Skopje (hereinafter: Service Provider), and the User as per the Membership Agreement (hereinafter: User), for the services of sharing "Avant2Go" electric vehicles.
1.2. By signing the Membership Agreement, the contracting parties confirm the validity of these General Terms, and the User's signature also constitutes an explicit and unconditional statement that:
They are fully acquainted with the content of the Membership Agreement and these General Terms, and at the same time confirm familiarity with the "Avant2Go" Location List, Price List, and Rules for Registration in the "Avant2Go" System (hereinafter collectively: Contractual Documentation),
They have fully read, understand, agree with, and accept the aforementioned Contractual Documentation.
1.3. The applicable Contractual Documentation at any given time (except the Membership Agreement) and other documentation, including:
Frequently Asked Questions and Answers (FAQ);
Privacy Policy; and
Other relevant guidelines from the Service Provider;
are always available to the User on the website www.avant2go.mk. These General Terms, Registration Rules, and Privacy Policy are also always available in the "Avant2Go" Mobile Application (APP), which also includes the Location List and Price List for vehicle sharing fees.
1.4. Any violation of these General Terms also constitutes a violation of the provisions of the Membership Agreement and is sufficient grounds for early termination of the Membership Agreement and any Distance Contract for sharing electric vehicles concluded based on the Membership Agreement.
1.5. Any User of the "Avant2Go" electric vehicle sharing service may also access vehicle rental services (rent-a-car) if the "Avant2Go" Mobile Application (APP) allows it. For the use of rent-a-car services, separate general terms ("Rent-a-Car General Terms") and reservation conditions ("Reservation Conditions") apply, which are available to the User in the "Avant2Go" Mobile Application (APP). The User utilizing rent-a-car services through the APP explicitly confirms, upon registration in the APP, that they are familiar with the Rent-a-Car General Terms, Reservation Conditions, and the Service Provider’s Privacy Policy (Privacy Statement), understands them, fully agrees with them, and accepts them. Before concluding an individual rental agreement by clicking the "Reserve Vehicle" button, the User explicitly declares that they have read and accepted these terms.

3. MEANING AND USE OF TERMS
3.1. The terms in the Contractual Documentation have the following meanings:
AVANT CAR DOO Skopje is the Service Provider of the "Avant2Go" electric vehicle sharing service.
Carsharing or sharing of "Avant2Go" electric vehicles is a self-service, short-term rental service of "Avant2Go" electric vehicles at designated locations (stations) 24 hours a day, every day of the year.
"Avant2Go" System is a cohesive whole comprising the Contractual Documentation, the "Avant2Go" Mobile Application (APP), and other documentation of the Service Provider, enabling the User to use the "Avant2Go" electric vehicle sharing services in the Republic of North Macedonia.
.GO+ is a designation for additional functionality or offer within the "Avant2Go" system, allowing Users to share "Avant2Go" electric vehicles, e.g., with a longer range, under the conditions specified in the Contractual Documentation.
APP or "Avant2Go" Mobile Application is the application through which the "Avant2Go" system operates.
Contractual Documentation includes the Rules for Registration in the "Avant2Go" System, the Membership Agreement, these General Terms for Sharing "Avant2Go" Electric Vehicles, the Price List, and the Location List. These General Terms and Registration Rules are always available in the "Avant2Go" Mobile Application (APP), which also includes the Location List and Price List for vehicle sharing fees.
Other Documentation includes FAQs, Privacy Policy, and other relevant guidelines, recommendations, and information provided by the Service Provider. All other applicable documentation of the Service Provider is always available on the website www.avant2go.mk, while the Privacy Policy is also available in the "Avant2Go" Mobile Application.
Location or “Avant2Go” Location is the place where an “Avant2Go” electric vehicle can be picked up for sharing and where it can be returned after the sharing is completed. The List of Locations is published on the website www.avant2go.mk and in the “Avant2Go” Mobile Application.
Membership Agreement or Membership Agreement for Sharing “Avant2Go” Electric Vehicles is the agreement with all its annexes, regulating all rights and obligations of the Member/Payer and the User of the “Avant2Go” electric vehicle sharing services, concluded before the User’s registration in the “Avant2Go” System.
Member is a natural or legal person who enters into the Membership Agreement for sharing “Avant2Go” electric vehicles and accepts these General Terms and Conditions for Sharing “Avant2Go” Electric Vehicles as well as other rules of the “Avant2Go” system. A legal person is considered any registered entity entered in the commercial register and/or the register of other legal entities at the Central Registry of the Republic of North Macedonia.
User (in the case of a Member – legal person, also the First User) is a natural person who, based on the Membership Agreement, has the right to use the “Avant2Go” electric vehicle sharing services. For a natural person, the User is the same as the Member, while for a legal person, the (First) User is the legal representative of the Member.
Second User is any other natural person who, in addition to the First User in the case of a legal person, has the right to share “Avant2Go” electric vehicles and is individually listed in the annex to the Membership Agreement.
Payer is a natural or legal person who undertakes to pay the fee for sharing “Avant2Go” electric vehicles and all other costs related to the sharing of “Avant2Go” electric vehicles by the User. As a rule, the Payer is the same as the Member, except in cases where the payment obligation is assumed on their behalf by a third party who is neither a Member nor a User (e.g., when the Member/User is a driver of the Payer who cannot operate an electric vehicle or cannot obtain a driver’s license due to physical disability, or when the Payer is a parent, spouse, or another person related to the Member/User, or in cases of other justified reasons or obstacles).
General Terms and Conditions or General Terms and Conditions for Sharing “Avant2Go” Electric Vehicles are these rules for using the “Avant2Go” electric vehicle sharing services, which apply in addition to the Membership Agreement and other Contractual Documentation (Registration Rules, Price List, and List of Locations).
Price List is a valid unilateral document of the Service Provider that determines the amount of fees and other costs related to the use of the “Avant2Go” electric vehicle sharing services, applicable at the time, and includes offers of periodic promotional packages. All prices include 18% VAT.
Contact Center provides operational assistance to Users 24 hours a day, every day of the year (24/7).
3.2. Terms referring to natural persons in these General Terms and Conditions for Sharing “Avant2Go” Electric Vehicles are stated in the grammatical form of the masculine noun and apply to both women and men.
3.3. The provisions of these General Terms and Conditions for Sharing “Avant2Go” Electric Vehicles that refer to the User, in the part defining the rights and responsibilities of the Member/Payer assumed under the Membership Agreement, also apply conceptually to the Member/Payer.
3.4. Hereinafter, for all “Avant2Go” electric vehicles that are the subject of the Membership Agreement and are available to the User for sharing based on it, the grammatical form of the singular noun is used.
4. SHARING OF THE “Avant2Go” ELECTRIC VEHICLE
4.1. The Service Provider guarantees the User’s right to share the “Avant2Go” electric vehicle, so that a User who properly and timely fulfills their obligations under the Membership Agreement for its entire duration may use the “Avant2Go” electric vehicle sharing services by entering into individual sharing agreements concluded remotely based on the Membership Agreement, under the conditions and in accordance with the Contractual Documentation and its provisions.
4.2. The “Avant2Go” electric vehicle may be shared and driven by a User who cumulatively meets the following conditions:
Is authorized to share and drive the “Avant2Go” electric vehicle in accordance with the Membership Agreement.
Has successfully completed identity verification and signed the Membership Agreement at the Service Provider’s headquarters or remotely using an electronic signature (remote agreement) and completed specialized training for sharing “Avant2Go” electric vehicles.
Holds a valid driver’s license in accordance with the legislation of the Republic of North Macedonia for the entire duration of each sharing of the “Avant2Go” electric vehicle.
Has no outstanding overdue obligations to the Service Provider for the duration of the Membership Agreement.
Has, for the purposes of each individual sharing of “Avant2Go” electric vehicles from the .GO+ offer, the necessary funds in the wallet within the “Avant2Go” Mobile Application (excluding the “benefits” section), in accordance with the Price List (this condition applies to sharing vehicles from the .GO+ offer).
The User may share “Avant2Go” electric vehicles only using their own “Avant2Go” profile (User’s username and password). In case of a change in the username and/or password (e.g., due to a change in email address, forgotten password, or other reasons), the User must log out of the “Avant2Go” Mobile Application on all devices through which they use the APP and log in again with the new credentials. The Service Provider’s liability for any damage that may occur to the User due to non-compliance with this rule is entirely excluded.
4.3. The User undertakes that for the entire duration of the sharing, they will use each “Avant2Go” electric vehicle carefully, respecting its usual or normal use, will take care of it as a good host, and in accordance with the relevant technical instructions of the manufacturer and other guidelines, recommendations, and good business practices, as well as the Contractual Documentation, while also considering good practices for operating the “Avant2Go” electric vehicle.
Usual or normal use of the “Avant2Go” electric vehicle means:
Urban use (e.g., on average up to 50 km per sharing) and occasional (no more than 20% of completed sharings in a month) longer trips up to 300 km/day (e.g., weekend trips). With explicit prior consent from the Service Provider, use beyond these limits is possible, while acting contrary to this provision constitutes a serious breach of the User’s contractual obligations.
Use that is in no way contrary to the rules of the Membership Agreement and other “Avant2Go” documentation.
Use within which the User always acts as a good host and always complies with the applicable regulations in the field of road traffic and road traffic safety.
The User must cumulatively meet all requirements listed in this paragraph.
4.4. The User also undertakes to use the “Avant2Go” electric charging stations or electric charging infrastructure carefully, appropriately for usual or normal use, as a good host, and in accordance with technical and other guidelines, recommendations, and good business practices.
4.5. During the sharing of the “Avant2Go” electric vehicle, the User may, at their discretion, provide transport to passengers known to them (relatives, friends, colleagues, etc.) and transport normal cargo (personal luggage and items), while respecting restrictions regarding the number of permitted persons (maximum as many as there are seat belts in the vehicle), permitted loads and vehicle capacity, and other restrictions from these General Terms and Conditions, as well as restrictions or obligations in accordance with currently applicable legal and subordinate regulations governing road traffic and road traffic safety. For any potential damage that may occur to the User’s passengers during the sharing and operation of the “Avant2Go” electric vehicle, proceedings are conducted in accordance with the insurance conditions of the insurance company where the “Avant2Go” electric vehicle is insured.
4.6. For any behavior contrary to the provisions of this Section 4, the User shall be liable to compensate the Service Provider for the caused damage. In addition to claiming compensation for material damage (ordinary damage) and any potential lost profit for the period when the vehicle could not be used, where the lost profit for each day the vehicle was unavailable is calculated based on the daily rental price for sharing such a vehicle, the Service Provider is also entitled to request early or immediate termination of the Membership Agreement.
5. RESTRICTIONS ON SHARING THE ELECTRIC VEHICLE “Avant2Go”
5.1. For the sake of road traffic safety, the safety of individuals, and the User’s responsibility for the “Avant2Go” electric vehicle, the User is strictly prohibited from allowing, transferring, lending, renting (with or without compensation), or in any other way permitting third parties to operate the “Avant2Go” electric vehicle.
If the User intentionally or negligently, or through other unauthorized actions, allows, permits, or enables (by handing over the vehicle, providing access to the APP, or otherwise) a third party to operate the “Avant2Go” electric vehicle (regardless of whether such third party meets the conditions for sharing an “Avant2Go” electric vehicle) or operates the vehicle themselves without a valid driver’s license, all insurance provisions for the “Avant2Go” electric vehicle are void. In such cases, it will be deemed that the “Avant2Go” electric vehicle was uninsured during such sharing and operation. The User is criminally and materially liable for any damage caused in this manner and must compensate the Service Provider. In justified, exceptional cases, the User may allow a third party to operate the “Avant2Go” electric vehicle (e.g., in case of a serious deterioration in the User’s health that prevents them from safely operating the vehicle), but only with prior consent from the Service Provider. In such cases, the User must, before the third party begins operating the vehicle, verify (to the extent their health condition allows) whether the third party is capable of operating the vehicle and, above all, whether they meet all contractual conditions for operating an “Avant2Go” electric vehicle, particularly those related to age and the validity of the driver’s license.
5.2. The “Avant2Go” electric vehicle must not be shared or operated:
Outside the territory of the Republic of North Macedonia, except in cases of exceptions specified in the third paragraph of Section 5.2 of these General Terms;
Under the influence of alcohol (in accordance with applicable legal regulations), drugs, or psychotropic substances (sedatives, hypnotic drugs, other medications, or other psychoactive substances) under which operating a vehicle is prohibited or not recommended;
If the vehicle, according to the manufacturer’s technical documentation, is overloaded with passengers, luggage, or goods, or is improperly loaded with cargo, or overloaded with passengers contrary to applicable regulations;
If the vehicle is not in a drivable condition or is not technically fully functional, and the User knows or should have known this, in accordance with legal provisions or the Service Provider’s instructions regarding the vehicle’s technical condition. The User must pay particular attention to the obligation to visually inspect the vehicle before starting to share it and to notify the Service Provider in case of excessive dirt, previously unnoticed damage, or technical defects that could affect the safety of operating the vehicle;
Contrary to regulations governing road traffic and road traffic safety;
Outside traffic surfaces intended for passenger vehicle traffic;
Beyond the driving limits permitted by road conditions;
In weather or other circumstances and conditions that could endanger the health and life of the User, their passengers, other road users, and/or could cause damage or defects to the “Avant2Go” electric vehicle;
For performing or advertising activities aimed at generating profit (e.g., paid passenger or goods transport, such as taxi services or other passenger and goods transport, driving school activities, or other vehicle operation training or driving skills training, such as safety exercises);
For participating in any sports or other competitions or vehicle testing;
To tow or pull any other vehicle, trailer, or object;
For transporting flammable, toxic, corrosive, explosive, infectious, or other hazardous substances or materials;
For transporting children under 5 years of age in the rear seat of the vehicle who are not seated in a special child seat secured to the vehicle seat with a seatbelt or other appropriate means; for transporting children under 12 years of age in the front seat of the vehicle; for transporting children under 2 years of age in the front seat of the vehicle if the airbag is not deactivated and the child is not transported in a special child seat positioned against the direction of travel, secured to the vehicle seat with a three-point seatbelt. In all cases, the User must comply with applicable legislation and the manufacturer’s instructions for installing and removing such child restraint systems;
For illegal purposes or actions;
For any other purposes contrary to the concluded Membership Agreement, these General Terms, applicable regulations, or any other purposes that would jeopardize or violate the Service Provider’s ownership rights over the “Avant2Go” electric vehicles.
These restrictions apply cumulatively to the User. Neither the Service Provider nor the insurance company insuring the “Avant2Go” electric vehicle shall be liable for any damages or losses resulting from non-compliance with these restrictions or arising from their violation.
Outside the borders of the Republic of North Macedonia, sharing or operating “Avant2Go” electric vehicles is permitted in the following cases:
If there are designated “Avant2Go” pick-up and drop-off locations in the territory of another country, and the purpose of the trip is to pick up or return the vehicle to one of those available locations; or
If the User has obtained prior explicit written consent from the Service Provider.
For any actions contrary to the provisions of Sections 5.1 and 5.2, the User shall be liable for the caused damage to the Service Provider. In addition to claiming compensation for material damage (ordinary damage) and any potential lost profit for the period when the vehicle could not be used (e.g., due to vehicle seizure by the police), where the lost profit for each day the vehicle was unavailable is calculated based on the daily rental price for sharing such a vehicle, the Service Provider is also entitled to request early or immediate termination of the Membership Agreement.
5.3. The following is not permitted in/on the “Avant2Go” electric vehicle:
Transporting animals, except for assistance animals (guide dogs) accompanying persons with special needs and pets with a body weight of up to 60 kg and a maximum shoulder height of 80 cm. In such cases, the animal must be appropriately secured during transport (using specially designed protective boxes: cage/basket/secured with a seatbelt), physically separated from the driver, and the User must take measures to protect the interior surfaces of the “Avant2Go” electric vehicle (e.g., placing a blanket);
Smoking, consuming alcoholic beverages, or using drugs or other prohibited psychotropic substances;
Consuming food or drinks if it could cause dirt in the “Avant2Go” electric vehicle (stains, crumbs, spilled drinks, etc.);
Leaving waste;
Removing accessories from the vehicle (except for: intended use of the charging card solely for (de)activating the charging station; use of emergency equipment, such as a reflective vest or first aid kit; keys in case of planned continuation of vehicle sharing);
Performing repairs, installing parts, removing parts from the vehicle, or any other intervention in the vehicle, as well as allowing such actions by third parties;
Deactivating/disabling airbags, except when transporting children using child seats in accordance with the manufacturer’s technical instructions, and the User must reactivate the airbags after completing the sharing;
Leaving personal items or other objects after completing the sharing;
Any other action, omission, or behavior that causes significant or obvious dirt to the “Avant2Go” electric vehicle, deviating from standard and conscientious use.

6. RESERVATION OF THE ELECTRIC VEHICLE “Avant2Go”
6.1. Through the “Avant2Go” mobile application,” the User can search for available “Avant2Go” electric vehicles at the List of “Avant2Go” Locations. The user selects the “Avant2Go” electric vehicle they wish to share by selecting the “Reservation” field. The reservation can be canceled in during the validity period (of up to 15 minutes) by selecting the “Cancel” field or extended by selecting the “Continue” field.
The Service Provider recommends that the User, before making a reservation for the “Avant2Go” electric vehicle they wish to share, check the vehicle’s proximity and the battery level of the selected vehicle to ensure timely pickup within the reservation’s validity period.
6.2. The Service Provider allows the User a free reservation of an electric vehicle from the “Avant2Go” and .GO+ offerings for up to 15 (fifteen) minutes, starting from the moment the “Reservation” field is selected. During the free reservation period, the User can cancel the reservation free of charge only once. Any subsequent, consecutive reservation will be calculated and charged in accordance with the applicable “Avant2Go” Price List.
The User can extend the reservation during its duration. In this case, depending on the vehicle type, the User will be charged a fee according to the Service Provider’s applicable Price List.
6.3. If the User, after making the first reservation for an “Avant2Go” electric vehicle, does not pick up the vehicle for sharing, nor cancels or extends the reservation, it is deemed that the User has canceled the reservation or has no intention of picking up the vehicle for sharing. The same applies to any subsequent, consecutive reservation, whereby the User will be charged a fee in accordance with point 6.2.
If the User extends the reservation and still does not pick up the “Avant2Go” electric vehicle for sharing even within the additional 15 minutes from selecting the “Continue” field, the reservation will be deemed canceled, and the User will be charged the fee from point 6.2.
7. PICKUP AND INSPECTION OF THE ELECTRIC VEHICLE “Avant2Go”
7.1. The pickup and sharing of the “Avant2Go” electric vehicle by the User is performed after the User selects the “Start Use” field in the “Avant2Go” mobile application. The User unlocks the vehicle by selecting the “Unlock” field. The “Avant2Go” electric vehicle is considered unlocked when the “Vehicle Unlocked” status is displayed in the APP and an audible signal indicating unlocking is heard.
The moment the User confirms the “Start Use” field for the “Avant2Go” electric vehicle in the APP, the User enters into a Distance Sharing Agreement with the Service Provider, assuming all rights and obligations contained in the Contractual Documentation.
Given that the User has accepted and signed the Membership Agreement before reserving and picking up the “Avant2Go” electric vehicle and that each individual vehicle sharing agreement is a distance contract, the User cannot withdraw from the Distance Sharing Agreement, except in cases where they refuse further sharing or operation of this “Avant2Go” electric vehicle as described below.
7.2. The Service Provider enables the User to share an “Avant2Go” electric vehicle with the following characteristics:
Usually clean and undamaged, except for possible minor damages or deficiencies that do not affect the ability to operate the “Avant2Go” electric vehicle or driving safety, which are listed for the specific “Avant2Go” electric vehicle in the “Avant2Go” mobile application;
Technically sound;
Registered;
Insured with mandatory motor liability insurance and comprehensive motor insurance;
Equipped with a vehicle start key, with its tag placed in the reader located in the glove compartment;
Equipped with legally prescribed and safety equipment (reflective triangle, reflective vest, first aid kit, spare bulbs, winter equipment);
Equipped with additional equipment (battery charging cables stored in the vehicle’s trunk, as well as other equipment listed);
Provided with a list of the “Avant2Go” electric vehicle’s equipment, available in the “Avant2Go” mobile application;
Provided with vehicle documents, including: traffic permit and mandatory motor liability insurance policy.
7.3. The User is obliged to immediately inspect the vehicle (externally and internally) and review the vehicle documents upon picking up the “Avant2Go” electric vehicle. Later complaints will not be considered.
7.4. If the User notices damage, defects, or deficiencies or observes that the vehicle is obviously dirty (e.g., soiled, smells of tobacco or tobacco products, etc.), they must report it before starting to operate the vehicle, and no later than 10 (ten) minutes from the moment of first unlocking or picking up the “Avant2Go” electric vehicle, by notifying the “Avant2Go” Contact Center at the phone number 0800 80 562. The User must describe the vehicle’s condition in detail to the Contact Center employee and then follow the instructions provided.
In case of visible damage or deficiencies, or if the vehicle is excessively dirty, the User must photograph the condition and immediately send the photos to the Service Provider via the “Avant2Go” mobile application.
The “Avant2Go” Contact Center employee may:
Terminate further sharing of the vehicle in case of damage, defects, or deficiencies to the “Avant2Go” electric vehicle that could affect its drivability or driving safety or passenger safety;
Approve further sharing of the vehicle in case of minor damages that do not affect the drivability of the “Avant2Go” electric vehicle or driving safety or passenger safety, and when the vehicle is obviously dirty, in which case the User has the right to refuse further sharing of the vehicle.
In case of refusal of further sharing, as per the previous paragraph, the User is exempt from payment obligations to the Service Provider for the refused sharing of the “Avant2Go” electric vehicle. If the User has already paid the sharing fee, they are entitled to a refund of the paid amount. To request a refund, the User must submit a refund request via email (or through the “Avant2Go” mobile application if such an option is available) within 8 (eight) days from the payment date. Generally, the User receives the refunded amount to the same payment method used for the payment. If the mobile application supports this option, the User may choose to receive the refund as credit in the “Avant2Go” mobile wallet instead of a refund to the payment method used.
The User may, either independently or at their request through the “Avant2Go” Contact Center employee, immediately reserve and pick up another available “Avant2Go” electric vehicle at an appropriate distance.
The Service Provider is not liable to the User in any case for any consequences, damages, or compensation in any way due to the refusal of further sharing of the “Avant2Go” electric vehicle.
7.5. If the User does not notify the “Avant2Go” Contact Center of possible damage, defects, or deficiencies or obvious dirt on the “Avant2Go” electric vehicle, it is deemed that the User has explicitly declared that:
They have carefully inspected the “Avant2Go” electric vehicle beforehand and are fully aware of its factual (usability and possible vehicle damage) and legal characteristics (vehicle documents);
The “Avant2Go” electric vehicle is in a condition for usual and normal use for sharing and operation (standardly clean, equipped with legally prescribed and additional equipment, and all vehicle documents);
The “Avant2Go” electric vehicle meets the purpose for which it is intended to be used;
They have no claims or complaints against the Service Provider on this basis and accept full responsibility and assume all risks related to the “Avant2Go” electric vehicle, its equipment, and vehicle documents, including the risk of destruction, damage, loss, seizure, and use exceeding normal usage, as per the terms of these General Terms, as well as liability towards third parties, from the moment the “Avant2Go” electric vehicle is picked up for sharing until its return.
8. DURATION OF SHARING AND SHARING FEE FOR THE ELECTRIC VEHICLE “Avant2Go”
8.1. The duration of sharing the “Avant2Go” electric vehicle is the time from the start of sharing to the end of sharing and return of the “Avant2Go” electric vehicle, calculated in minutes. During the sharing period, the User must not leave the “Avant2Go” electric vehicle unlocked or open (windows, doors, trunk). The User undertakes to immediately notify the “Avant2Go” Contact Center at 0800 80 562 of any possible error, deficiency, or damage to the “Avant2Go” electric vehicle that may occur during sharing and to act in accordance with the instructions provided.
8.2. The continuous duration of sharing the “Avant2Go” electric vehicle is limited to a maximum of 72 hours (4,320 minutes), unless otherwise explicitly agreed between the User and the Service Provider. If the User does not complete the sharing within the specified period or does not notify the “Avant2Go” Contact Center at 0800 80 562 in advance of exceeding the duration, it is deemed that after the expiration of 72 hours (except in case of a prior explicit agreement, as stated above) of uninterrupted sharing, the Service Provider unilaterally terminates the Distance Sharing Agreement, and the User acknowledges the Service Provider’s right to repossess the “Avant2Go” electric vehicle from the User.
During the sharing period, the number of kilometers traveled is recorded by a factory-installed and sealed odometer, which the Service Provider reads remotely (via GPS).
8.3. The fee for sharing the “Avant2Go” electric vehicle is calculated in accordance with the Membership Agreement and the amount specified in the Service Provider’s applicable “Avant2Go” Price List and consists of:
The tariff, calculated based on the sharing time, i.e., the entire duration of sharing, regardless of the number of kilometers traveled, whereby the initial minute lasting less than 60 seconds is counted as a minute; and
The mileage, calculated based on the kilometers traveled during the sharing period, whereby the initial kilometer shorter than 1,000 meters is counted as a kilometer.
When the User reaches the highest daily sharing price with the sum of the time spent and kilometers traveled, which are included in the daily sharing price according to the Price List, this price applies for 24 hours from the start of sharing. After 24 hours, the next day of use within the same sharing period starts again with the sum of kilometers traveled, which, according to the Price List, are included in the daily sharing price, and the time spent, until the highest daily sharing price is reached again.
If, according to the Price List, a kilometer limit applies to the vehicle for the daily sharing price, and the User exceeds this number of kilometers within 24 hours from the start of sharing, each additional kilometer traveled within the same 24 hours will be additionally charged. The calculation will be made in accordance with the applicable Price List.
8.4. The User may pay the fee using credit from the so-called electronic wallet in the “Avant2Go” mobile application, which can be obtained by purchasing a package or depositing funds into the wallet, or by directly paying after completing the sharing. The validity period of the credit obtained by purchasing a package or depositing funds into the wallet is 3 (three) years from the date of purchase/deposit.
At the User’s request, the Service Provider will refund the paid amount for the package or funds deposited into the wallet only upon termination of the contractual relationship and after settling all possible obligations to the Service Provider. In the case of purchasing the first package upon registration, the User is refunded the unused portion of the paid funds, reduced by the registration fee amount, if included in the package. For requests to refund the second or any subsequent purchased package or funds deposited into the wallet, the Service Provider refunds the entire unused portion of the paid funds. If the User purchases a package that includes additional gifted funds, the User is entitled to a refund of the unused portion of the paid funds, reduced by the amount proportional to the used portion of the gifted funds (which are always used first). If the User has completed fewer than 3 (three) sharings before requesting a refund, the Service Provider may charge a processing fee for the refund, as per the Price List.
8.5. The User is obliged to verify the accuracy of the data on each invoice issued by the Service Provider and to submit any objections regarding the invoice to the email address support@avant2go.mk no later than 8 (eight) days from the date of receipt of the invoice. Objections submitted after the expiration of the 8-day period will not be considered by the Service Provider.
9. ELECTRIC ENERGY, ELECTRIC BATTERY, AND CHARGING
9.1. The electric energy at “Avant2Go” charging stations is included in the sharing fee for the “Avant2Go” electric vehicle. The Service Provider is not responsible for the costs of charging the electric battery at non-“Avant2Go” charging stations. When charging “Avant2Go” electric vehicles at non-“Avant2Go” charging stations due to the User’s choice or fault, additional costs may arise after a certain period, depending on the charging station operator (e.g., costs if the vehicle remains connected to the charging station after charging is complete, and the operator charges for this). In such cases, the Service Provider reserves the right to charge the User these costs, along with other Service Provider fees, in accordance with the Price List.
9.2. The User picks up the electric vehicle, in principle, with the battery level as displayed before the reservation or when selecting the “Avant2Go” electric vehicle in the mobile application (APP).
9.3. The User is obliged to monitor the battery level and, during the sharing of the “Avant2Go” electric vehicle, ensure a sufficient battery level to complete the planned route, and, if necessary, charge the electric battery at “Avant2Go” charging stations during the journey.
9.4. Upon completing the sharing, the User, at their discretion, connects the electric vehicle to a charging station if there is an available charging station at the selected Location. If the electric battery’s energy level is less than 30% and the Location has an available charging station, the Service Provider recommends that the User act carefully and connect the vehicle to the “Avant2Go” charging station.
9.5. When connecting the electric battery to a charging station, the User must pay particular attention to properly connecting the cable and consider the restrictions on using the electric energy charging station, and above all, be aware that:
It is not safe to use the charging infrastructure during weather conditions that could negatively affect the charging station (e.g., risk of lightning strikes);
The charging infrastructure and charging cable must not be touched with wet hands;
Charging stations must not be used by persons under 21 years of age;
To prevent electric shock during battery charging, the plug is locked in the “Avant2Go” electric vehicle, and the User must not attempt to forcibly remove it;
A User with an implanted pacemaker must not:
Approach closer than 80 centimeters to the rear of the charging station, or
Approach closer than 80 centimeters to the front of the charging station during battery charging.
9.6. The User is liable to the Service Provider for any damage caused to the “Avant2Go” electric vehicle or the charging station or “Avant2Go” charging infrastructure due to improper use of the charging station or improper handling during electric energy supply.
10. PERMITTED AREAS, PARKING, AND “Avant2Go” LOCATIONS
10.1. In principle, the User picks up the “Avant2Go” electric vehicle for sharing from an “Avant2Go” Location.
10.2. The User must not cross the border of the Republic of North Macedonia with the “Avant2Go” electric vehicle, except in case of a prior agreement with the Service Provider.
10.3. The User is obliged to return the vehicle from sharing to the designated places for this purpose at an “Avant2Go” Location; otherwise, they will be charged a fee for locating and returning an improperly parked “Avant2Go” electric vehicle (this applies, among other things, to parking in spaces not intended for parking, such as parking in spaces for persons with disabilities or parking in spaces designated for charging vehicles on public infrastructure when the vehicle is not being charged, etc.), and, if necessary, a towing fee for the “Avant2Go” electric vehicle (e.g., due to a depleted battery), all in accordance with the Price List.
10.4. Leaving or parking the “Avant2Go” electric vehicle during the sharing period is permitted only in designated places for this purpose (public and private parking lots) and in the prescribed manner, in accordance with the parking conditions of the specific parking lot (e.g., time restrictions, payment of parking fees).
10.5. “Avant2Go” Locations are places designated exclusively for:
Picking up the “Avant2Go” electric vehicle for sharing;
Charging the electric battery of the “Avant2Go” electric vehicle;
Returning the “Avant2Go” electric vehicle from sharing.
10.6. The list of Locations is always available to the User in the “Avant2Go” mobile application.
11. RETURNING THE “Avant2Go” ELECTRIC VEHICLE AND COMPLETING THE SHARING
11.1. The User undertakes to return the “Avant2Go” electric vehicle, which they have taken based on the Membership Agreement or the Distance Sharing Agreement concluded based on it, together with the vehicle documents and equipment, to the designated place where returning the vehicle from sharing is permitted (Location).
11.2. The User undertakes to return the vehicle in an appropriate condition, considering its normal use, technically sound, with an appropriate electric battery level, in compliance with provision 9.4 of these General Terms, without third-party items, and fully prepared for normal use.
11.3. The User may return the “Avant2Go” electric vehicle when the following conditions are cumulatively met:
The vehicle start key is placed in the glove compartment, with the tag containing the built-in transmitter inserted into the reader’s slot located in the glove compartment;
The electric vehicle is parked at an “Avant2Go” Location, whereby the Service Provider recommends that the User connect the vehicle to a charging station if the electric battery level is below 30%;
All windows and doors of the “Avant2Go” electric vehicle are closed, and all lights and turn signals are turned off;
All charging cables are in the vehicle (the number of charging cables for each vehicle is specified in the APP).
11.4. The User completes the sharing of the “Avant2Go” electric vehicle as follows:
In the “Avant2Go” mobile application, selects the “Lock Vehicle” field and physically checks (by pulling the doors) whether the vehicle is indeed locked;
In the APP, confirms all required fields (closed doors, turned-off lights, cables in the vehicle, mandatory equipment, etc.);
After locking the vehicle and confirming all fields in the APP, selects the “End Sharing” field. Upon making this selection, the User is charged the sharing fees;
The User pays the sharing fee.
Until all the above steps are fully completed, the sharing is considered ongoing, and any additional fees for sharing the “Avant2Go” electric vehicle that has not been returned properly will be additionally charged to the User.
11.5. If it is not possible to complete the sharing due to the loss of the mobile phone, disruptions in the User’s mobile network operator, or issues with the APP’s functionality, the User must notify the “Avant2Go” Contact Center at 0800 80 562 or via email at support@avant2go.mk as soon as possible, and no later than 30 minutes from the moment they intended to complete the sharing. In this case, the end of sharing will be considered the moment confirmed by the “Avant2Go” Contact Center employee.
11.6. If the User forgets to complete the sharing, the Service Provider may, at the User’s request, complete it. In this case, the User may be granted the option to complete the sharing at the time they brought the vehicle to the final location, for which the Service Provider charges the User a fee for completing the sharing, as per the Price List.
12. REPOSSESSION OF THE “Avant2Go” ELECTRIC VEHICLE
12.1. The Service Provider may repossess the “Avant2Go” electric vehicle from the User during the sharing period in the following cases:
When the User exceeds the maximum permitted sharing duration (72 hours) and has not notified the “Avant2Go” Contact Center of the overrun before the permitted duration expires and has not obtained the Service Provider’s consent to extend the sharing; or
The User crosses the border of the Republic of North Macedonia with the “Avant2Go” electric vehicle, except in case of a prior agreement with the Service Provider; or
The User’s driver’s license has been temporarily revoked, a misdemeanor sanction prohibiting vehicle operation has been imposed, a misdemeanor sanction terminating the validity of the driver’s license has been imposed, or the driver’s license has expired; or
The Membership Agreement has been terminated, regardless of the reason; or
This is necessary to protect the Service Provider’s property and legal interests.
12.2. Repossession of the “Avant2Go” electric vehicle may be carried out:
In cooperation with the User, whereby the User, immediately upon being requested by a “Avant2Go” Contact Center employee via phone, returns the “Avant2Go” electric vehicle and completes the sharing in accordance with the Contractual Documentation;
Without the User’s cooperation by:
Blocking the starting and operation of the “Avant2Go” electric vehicle;
Reporting the misappropriation of the “Avant2Go” electric vehicle to the competent police station; and
Taking possession of the “Avant2Go” electric vehicle.
12.3. In all cases listed in point 12.1 of these General Terms, the User explicitly and unconditionally acknowledges the Service Provider’s right to immediately repossess the “Avant2Go” electric vehicle in any of the ways described above and explicitly and unconditionally permits the Service Provider to repossess the “Avant2Go” electric vehicle to protect the Service Provider’s property.
12.4. The User is liable to the Service Provider for all costs of taking possession of the “Avant2Go” electric vehicle, for the incurred and determined material damage (ordinary damage) and lost profit.
13. INSPECTION OF THE “Avant2Go” ELECTRIC VEHICLE UPON RETURN OR REPOSSESSION
13.1. If the Service Provider, upon taking possession of the vehicle, determines that the condition of the returned “Avant2Go” electric vehicle is not appropriate (cleanliness, battery level, obvious damage, tobacco odor, etc.) or that the User has used it contrary to the provisions of the Membership Agreement and other Contractual Documentation, the Service Provider has the right to conduct necessary inspections and repairs and perform other actions at the User’s expense to restore the “Avant2Go” electric vehicle to its original condition.
13.2. “Avant2Go” electric vehicles may be equipped with a damage detection system and/or a smoke detection system (e.g., from smoking). The damage detection system enables the Service Provider to automatically detect vehicle damage with high precision, including the exact time, place, and location of the damage. The smoke detection system enables automatic detection of smoke in the vehicle with high precision, including the exact time of the event. Data obtained through the damage and/or smoke detection system will be verified by the Service Provider through a physical inspection of the vehicle. Based on the system’s report and after the event is confirmed by a physical inspection of the vehicle (damage/smoke), the Service Provider will identify the specific User who used the sharing service at the time of the detected unauthorized action.
13.3. If the User does not return all received vehicle-related documents or the vehicle’s equipment or accessories, they are obliged to compensate the Service Provider for all costs of their replacement.
13.4. Vital vehicle components are sealed or marked with factory numbers. If the Service Provider determines that a component is missing or replaced, they have the right to charge the User for the entire incurred damage.
13.5. The Service Provider has the right to claim compensation from the User if the User intentionally or through gross negligence fails to take necessary actions to eliminate the vehicle’s legal, technical, or economic unusability or reduced usability.
13.6. In the cases mentioned in the previous paragraphs, the User is obliged to compensate the Service Provider for all obligations related to costs and other fees in accordance with the applicable Price List, including the obligation to compensate for the entire incurred damage, including any lost profit for the period when the “Avant2Go” electric vehicle could not be used for providing the “Avant2Go” service, whereby the lost profit for each day the vehicle was unavailable is calculated based on the daily sharing price for such a vehicle according to the applicable Price List.
13.7. Considering the provisions of points 5.3 and 11.4 of these General Terms, the User is obliged to immediately remove all personal items or items of their passengers from the vehicle upon completing each sharing. The Service Provider assumes no responsibility for items left by the User or a third party in or on the “Avant2Go” electric vehicle or in any replacement vehicle after completing the sharing, regardless of whether the sharing ended through regular return or repossession of the vehicle in any of the ways described above, nor for items left by the User or a third party at the Service Provider’s premises. The User is solely responsible for the loss, damage, and/or destruction of their own items and those of third parties. Regardless of the circumstances, the Service Provider does not offer storage for items left in the “Avant2Go” vehicle, and the User must immediately retrieve them or authorize another person in writing to retrieve them. If a large quantity of items remains in the “Avant2Go” vehicle, the Service Provider reserves the right to dispose of the items if they are not retrieved by the User after being notified, and the Service Provider is not liable for any possible damage or other consequences incurred by the User as a result. The Service Provider stores small forgotten items in the “Avant2Go” vehicle at its premises for a limited period (up to 30 days).
14. DEFECT OF THE “Avant2Go” ELECTRIC VEHICLE
14.1. In case of a defect, the User is obliged to immediately notify the “Avant2Go” Contact Center at 0800 80 562 and act in accordance with the instructions provided.
14.2. If the User acts contrary to the provisions of this point, repairs the “Avant2Go” electric vehicle on their own, or if a defect occurs due to improper use or operation by the User, the costs of defect removal or repair are borne by the User, who is also obliged to compensate the Service Provider for all legally recognized damage resulting from such actions.
15. INTERVENTIONS ON THE “Avant2Go” ELECTRIC VEHICLE
15.1. It is prohibited to make any changes, modifications, installations, or other interventions on the “Avant2Go” electric vehicle.
15.2. The User is explicitly prohibited from making any changes or interventions on the odometers/meters and the vehicle’s electronic or electrical equipment.
15.3. If the User acts contrary to the provisions of this point, the User is obliged to compensate the Service Provider for the costs of restoring the vehicle to its original condition, as well as the entire material damage (ordinary damage) and lost profit for the period when the individual “Avant2Go” electric vehicle could not be used for providing the “Avant2Go” service, whereby the lost profit for each day the vehicle was unavailable is calculated based on the daily sharing price for such a vehicle according to the applicable Price List, incurred by the Service Provider as a result of the User’s actions.
16. USER’S OBLIGATIONS IN CASE OF DAMAGE
16.1. If the “Avant2Go” electric vehicle is damaged (regardless of the extent of the damage), destroyed, seized, or stolen, or if the vehicle is involved in a traffic or other accident (in case of damage) that may lead to a legal dispute between the Service Provider and the User or between the Service Provider and third parties, the User is obliged to immediately notify the “Avant2Go” Contact Center at 0800 80 562 during the sharing period, and no later than 1 (one) hour from the occurrence of the damaging event (final deadline), and act in accordance with further instructions. In case of theft or fire of the vehicle, the User must immediately, without delay, report the event to the police; in case of a traffic or other accident, the User must immediately, without delay, report the event to the police, except in cases of vehicle damage where the legal conditions for completing a European Accident Report are met. In all the above cases, the User must resubmit their driver’s license for inspection to the Service Provider upon request.
16.2. The User undertakes to protect the interests of the Service Provider and its insurance company in case the “Avant2Go” electric vehicle is involved in any traffic or other accident, or in case of damage to/with the “Avant2Go” electric vehicle, by:
Recording the names and addresses of all involved participants and witnesses to the accident, as well as the registration numbers of the involved vehicles;
Providing first aid to any injured persons;
Not abandoning the damaged vehicle until it is secured or moved to a safe location;
Not admitting fault to third parties;
In all cases, immediately calling the police, informing them of the accident, awaiting their arrival and the preparation of the relevant official accident report, and obtaining a copy of said report, whereby the User undertakes to provide the police with accurate and truthful information about the circumstances, causes, and consequences of the event;
Thoroughly completing the European Accident Report, drawing a sketch, and providing their truthful statement, which they will immediately submit to the Service Provider.
16.3. In case of a damaging event, regardless of whether it involves partial damage or complete destruction or loss of the vehicle, the User is obliged to preserve all evidence of the event and obtain documentation of the damaging event necessary for filing a damage claim.
For untimely or non-fulfillment of the obligations in this point, the User is obliged to compensate the Service Provider for the damage, and the Service Provider may also request early termination of the Membership Agreement with the User, with all consequences arising from early termination due to the User’s fault.
16.4. If the paid compensation or insurance premium paid by the insurance company is insufficient to cover the entire damage, or if the insurance company refuses to pay the premium or compensation for reasons not attributable to the Service Provider, the User is obliged to compensate the Service Provider for the difference up to the full amount of the damage, including material damage (ordinary damage) and lost profit for the period when the individual “Avant2Go” electric vehicle could not be used for providing the “Avant2Go” service, whereby the lost profit for each day the vehicle was unavailable is calculated based on the daily sharing price for such a vehicle according to the applicable Price List. In cases where the insurance company determines that the full responsibility for the damage lies with the User, the insurance company has the right to seek recourse directly from the User.
16.5. In case of confirmed damage caused by the User, the Service Provider has the right to charge the User processing fees for handling the damage case, in accordance with the Price List.
17. INSURANCE COVERAGE AND DAMAGE
17.1. Each individual “Avant2Go” electric vehicle is insured in accordance with the applicable regulations of the Republic of North Macedonia and the general terms of the insurance company, as evident from the insurance policy for each individual “Avant2Go” electric vehicle, available for inspection in original at the Service Provider, and to the extent agreed in the Membership Agreement (conclusion of comprehensive motor insurance, User’s liability for vehicle-related damage in the amount specified in the Price List).
17.2. Regardless of the concluded insurance policy for the individual “Avant2Go” electric vehicle, the User is obliged to compensate the Service Provider for any potential damage to the individual electric vehicle and/or equipment, including lost profit and costs specified in the applicable Price List, in the following cases:
If the “Avant2Go” electric vehicle is insured with comprehensive motor insurance, the User bears liability for vehicle-related damage in accordance with point 17.3;
If there is damage to the vehicle’s interior, tires, wheels, hubcaps, windshield wipers, antenna, lighting devices, glass surfaces, vehicle undercarriage, clutch damage or wear, brake disc overheating, siren destruction, chassis optics imbalance, chassis damage, and other vehicle or component damages not covered by the insurance company;
If the User caused the damage under the influence of alcohol (in accordance with applicable legal regulations), drugs, or psychotropic substances (sedatives, hypnotic drugs, other medications, or other psychoactive substances) known to prohibit or advise against driving;
If the User caused the damage intentionally or through gross negligence;
If the User did not have a valid driver’s license or was prohibited from operating a vehicle at the time of the damage;
If the damage occurred outside the territory of the Republic of North Macedonia, regardless of the User’s fault;
If the damage occurred due to other violations of the provisions of point 5 (restrictions on sharing the “Avant2Go” electric vehicle) or due to use of the vehicle contrary to the provisions of the Contractual Documentation;
If the User fled the scene of the accident, regardless of fault;
In other cases not covered by the insurance company or exceeding the insurance coverage limit, regardless of the User’s fault;
In case of an unsuccessful legal dispute against third parties, including the entire damage, costs, and fees.
17.3. The User is obliged to compensate the Service Provider for damage caused by third parties during the period when the User bears the risks associated with the “Avant2Go” electric vehicle and/or its use, regardless of fault, whereby the above provisions apply accordingly. The User also fully covers third-party damage claims not covered by the insurance company. If the User is responsible for vehicle damage covered by the insurance company, the User is, in any case, liable to the Service Provider for vehicle damage in the amount specified in the applicable Price List.
17.4. The “Avant2Go” electric vehicle is insured only for the duration of the Membership Agreement. After the expiration of the Membership Agreement, the Service Provider is not liable for traffic accidents or other damage, loss, or destruction of the vehicle, which are considered the User’s personal responsibility, whereby the User is obliged to compensate for the entire potential damage, regardless of the vehicle’s current insurance.
17.5. Only the Service Provider has the right to file a damage claim in case of damage. If the premium/damage compensation is insufficient to cover the entire material damage and any lost profit incurred by the Service Provider, the User is obliged to compensate the Service Provider for the entire such damage within 8 (eight) days from the date of the Service Provider’s written request sent via email to the User’s email address. In cases where the insurance company determines that the full responsibility for the damage lies with the User, the insurance company has the right to seek recourse directly from the User.
18. COMPLIANCE WITH TRAFFIC REGULATIONS
18.1. The User is responsible and assumes all obligations arising from non-compliance with traffic regulations, improper parking, or other violations of legal regulations during the sharing of the “Avant2Go” electric vehicle, and for all damage caused by the same.
18.2. The User undertakes to pay all potential fines, penalties, and other sanctions for committed offenses with the “Avant2Go” electric vehicle during the sharing period independently, without the Service Provider’s intervention, and if this is not possible, to compensate the Service Provider for all amounts and related costs owed to them if the Service Provider makes the payment on the User’s behalf. This User responsibility continues even after the expiration of the Membership Agreement or Distance Sharing Agreement if such fines or penalties arise from the period when the User was sharing the “Avant2Go” electric vehicle.
19. USE OF ELECTRONIC SIGNATURE FOR SIGNING THE AGREEMENT
19.1. The User has the option to electronically sign the Membership Agreement using an electronic signature, whereby, by selecting this option, the User:
Consents to using an electronic document and electronic signature, confirming that they fully understand that the electronic signature and electronic document have the same legal force as a printed document and handwritten signature;
Confirms that they have read the electronic document (Membership Agreement) and the data subject to electronic signing;
Receives an email at their email address with instructions for electronically signing the Membership Agreement and follows the provided instructions. The User consents that the unique code received via SMS on their mobile phone will be used as their electronic signature, whereby they electronically sign the Membership Agreement and acknowledge, accept, and undertake that such signing represents an expression of their will to enter into a contractual relationship and assume the obligations arising from the Membership Agreement concluded between them and the Service Provider for using the “Avant2Go” electric vehicle sharing services;
After signing, the system sends an email to the User’s email address as confirmation of the signed Membership Agreement, whereby the User receives a copy of the signed Membership Agreement (electronic document). The storage and sharing of the electronic document is the User’s responsibility and right. The email address to which the confirmation and copy of the Membership Agreement are sent is verified by the User in the “Avant2Go” system;
The electronic signing of the Membership Agreement complies with the applicable Law on Electronic Documents, Electronic Identification, and Trust Services and other applicable legal regulations;
The electronic signing of the Membership Agreement is used exclusively for regulating contractual relations between the User and the Service Provider regarding the use of “Avant2Go” electric vehicle sharing services;
The data used for electronic signing comply with the Law on Personal Data Protection;
The Membership Agreement is signed in PDF format, which ensures advanced and secure authentication and precise forensic examination, if needed, to prove the document’s authenticity.
20. WITHDRAWAL FROM THE AGREEMENT
The User has the right to withdraw, without a notice period, only from the Membership Agreement concluded remotely or outside the Service Provider’s business premises, in accordance with the following provisions:
20.1. The User has the right to withdraw from the Membership Agreement within 14 days without providing a reason or explanation for the withdrawal, if the agreement was concluded remotely (signed with an electronic signature remotely) or outside the Service Provider’s business premises, in accordance with the provisions of the applicable Law on Consumer Protection. The withdrawal period expires 14 days from the date of concluding the Membership Agreement.
20.2. To exercise their right of withdrawal, the User must notify the Service Provider (AVANT CAR DOO Skopje, ul. 11-ti Oktomvri br. 2 Centar, Skopje, email: support@avant2go.mk, phone: 0800 80 562) of their decision to withdraw from the Membership Agreement with an unequivocal statement via email to the above email address or in written form via registered mail to the above address of the Service Provider’s headquarters.
20.3. For timely withdrawal from the Membership Agreement, it is sufficient for the User to send the withdrawal notice to the Service Provider in one of the above ways before the 14-day withdrawal period expires.
20.4. If the User withdraws from the Membership Agreement, the Service Provider will refund all payments made by the User without delay, and in any case no later than 14 days from the date of receiving the withdrawal notice. The Service Provider will make the refund using the same payment method used by the User for payment, unless the User explicitly agrees otherwise. The User will not incur any costs or fees related to such a refund.
20.5. Notwithstanding point 19.4, the User is not entitled to a refund of the one-time registration fee. If the User has started using the “Avant2Go” electric vehicle sharing service during the withdrawal period, the User is obliged to pay the Service Provider the fee for the services provided.
20.6. The User cannot withdraw from the Membership Agreement in cases where the Service Provider has fully performed the agreement and started providing the service to the User, but only if the performance began with the User’s prior explicit consent, which also confirms that by the Service Provider’s performance of the Membership Agreement, the User will lose the right to withdraw from the Membership Agreement.
20.7. The User cannot withdraw from individual Distance Sharing Agreements, except in the cases and manner specified in point 7 of these General Terms.
21. REFERRAL PROGRAM RULES: REFER AND GET BENEFITS
21.1. Within the Referral Program: Refer and Get Benefits, the Service Provider offers all existing Users with an active user profile (hereinafter: “Existing Member”) the opportunity to receive an additional benefit in the form of a voucher for sharing “Avant2Go” electric vehicles. This point of the General Terms establishes the specific conditions for participating in obtaining benefits and the rules for receiving benefits.
21.2. The Existing Member can obtain and use the benefit as follows:
In the “Avant2Go” mobile application, by clicking on the “Refer and Get a Discount” window, accessing their unique referral code;
By clicking the “Share” button, they send an invitation to desired individuals who are not yet registered in the “Avant2Go” system via the chosen method (SMS, email, or other direct message) with an indication of the benefit’s value (voucher) and a link to the unique referral code;
The person receiving the invitation and link to the unique referral code registers in the “Avant2Go” system, enters the received unique referral code during registration, purchases one of the available packages, signs the Membership Agreement, becomes a Member of “Avant2Go”, and can then complete their first sharing with an “Avant2Go” electric vehicle (hereinafter: “New Member”);
When the New Member completes their first sharing with an “Avant2Go” electric vehicle, both the Existing Member who provided the unique referral code and the New Member receive an email with a voucher statement and notification of the voucher’s activation, its value, usage method, and how to track the voucher’s status;
The received voucher can be used by the Member exclusively for sharing “Avant2Go” electric vehicles, whereby, during the vehicle reservation process in the APP, before clicking the “Reserve Vehicle” button, they activate the “Use Benefit” option, and the sharing payment is made using the voucher.
21.3. The Member can track the voucher’s status in the APP under the “Benefits” section, located under the “Wallet” icon, until the voucher’s full value is used or, if the voucher’s validity period is limited, until its expiration. The Member can use the voucher exclusively for sharing “Avant2Go” electric vehicles until its value is exhausted or, if the validity period is limited, until it expires. The voucher’s value and validity period are specified in the APP under the “Benefits” section.
21.4. During the referral program, the Existing Member can share their unique referral code with an unlimited number of people in the manner described above and, by meeting the above conditions, gain the opportunity to activate and use multiple vouchers.
21.5. The New Member, after completing their first ride with an “Avant2Go” electric vehicle, receives their own unique referral code in the APP, and thus the opportunity, after clicking the “Refer and Get Benefits” button and completing the procedure outlined in point 21.2, to receive a new benefit based on activating a new voucher.
21.6. The unique referral code is assigned to each Member who is a natural person, as well as to each User sharing “Avant2Go” electric vehicles based on a Membership Agreement signed with a legal entity. The latter, in case of sharing the unique referral code and activating a voucher based on the New Member’s first sharing, can use the voucher only if they signed the Membership Agreement as a natural person. After the New Member completes their first sharing, Members/Users can use the activated voucher only for private rides and exclusively for sharing “Avant2Go” electric vehicles.
21.7. The Service Provider reserves the right to modify, upgrade, or discontinue the implementation of the Referral Program: Refer and Get Benefits at any time or to resume its implementation under modified conditions, without affecting the already acquired rights of Members arising from voucher activation, as per the fourth bullet of point 21.2. Thus, in case of changes or discontinuation of the referral program, Members/Users who have already received an activated voucher up to the moment of the change/discontinuation can use such a voucher in accordance with the program’s conditions under which they obtained the benefit.
21.8. Members/Users can use the acquired activated voucher, in the amount issued, exclusively for sharings within the “Avant2Go” electric vehicle sharing service. Members/Users cannot exchange the voucher for another service of the “Avant2Go” system or any other service of the Service Provider.
21.9. Members/Users cannot request the voucher’s value to be paid out in cash or via bank transfer, nor can they use the voucher’s value to settle unpaid sharing fees for “Avant2Go” electric vehicles or other outstanding obligations that may be charged to the Member under the provisions of the Membership Agreement or these General Terms.
21.10. The benefits from the voucher cannot be transferred between “Avant2Go” user accounts, nor can the Member transfer the voucher’s benefits to their user account for sharing “Avant2Go” electric vehicles in other countries where the service is available.
21.11. Each Existing Member receives only one unique referral code, and thus the opportunity to receive a voucher based on sharing this unique referral code. If a Member activates one or more additional user profiles, the Service Provider reserves the right to prevent this Member from sharing the unique referral code or to disable the activation and use of the voucher on all additional user profiles.
21.12. An already acquired but unused voucher does not prevent the Service Provider from terminating the Membership Agreement in accordance with the provisions of the Membership Agreement and these General Terms. In case of termination of the Membership Agreement for any reason given by the Service Provider or the Member, the Member cannot request the payout of the voucher’s value.

User’s personal belongings or other items after completing the sharing;
Any other action, omission, or behavior that causes significant or obvious dirt to the “Avant2Go” electric vehicle, deviating from standard and conscientious use;
6. RESERVATION OF THE ELECTRIC VEHICLE “Avant2Go”
6.1. Through the “Avant2Go” mobile application,” the User can search for available “Avant2Go” electric vehicles at the List of “Avant2Go” Locations. The user selects the “Avant2Go” electric vehicle they wish to share by selecting the “Reservation” field. The reservation can be canceled in during the validity period (of up to 15 minutes) by selecting the “Cancel” field or extended by selecting the “Continue” field.
The Service Provider recommends that the User, before making a reservation for the “Avant2Go” electric vehicle they wish to share, check the vehicle’s proximity and the battery level of the selected vehicle to ensure timely pickup within the reservation’s validity period.
6.2. The Service Provider allows the User a free reservation of an electric vehicle from the “Avant2Go” and .GO+ offerings for up to 15 (fifteen) minutes, starting from the moment the “Reservation” field is selected. During the free reservation period, the User can cancel the reservation free of charge only once. Any subsequent, consecutive reservation will be calculated and charged in accordance with the applicable “Avant2Go” Price List.
The User can extend the reservation during its duration. In this case, depending on the vehicle type, the User will be charged a fee according to the Service Provider’s applicable Price List.
6.3. If the User, after making the first reservation for an “Avant2Go” electric vehicle, does not pick up the vehicle for sharing, nor cancels or extends the reservation, it is deemed that the User has canceled the reservation or has no intention of picking up the vehicle for sharing. The same applies to any subsequent, consecutive reservation, whereby the User will be charged a fee in accordance with point 6.2.
If the User extends the reservation and still does not pick up the “Avant2Go” electric vehicle for sharing even within the additional 15 minutes from selecting the “Continue” field, the reservation will be deemed canceled, and the User will be charged the fee from point 6.2.
7. PICKUP AND INSPECTION OF THE ELECTRIC VEHICLE “Avant2Go”
7.1. The pickup and sharing of the “Avant2Go” electric vehicle by the User is performed after the User selects the “Start Use” field in the “Avant2Go” mobile application. The User unlocks the vehicle by selecting the “Unlock” field. The “Avant2Go” electric vehicle is considered unlocked when the “Vehicle Unlocked” status is displayed in the APP and an audible signal indicating unlocking is heard.
The moment the User confirms the “Start Use” field for the “Avant2Go” electric vehicle in the APP, the User enters into a Distance Sharing Agreement with the Service Provider, assuming all rights and obligations contained in the Contractual Documentation.
Given that the User has accepted and signed the Membership Agreement before reserving and picking up the “Avant2Go” electric vehicle and that each individual vehicle sharing agreement is a distance contract, the User cannot withdraw from the Distance Sharing Agreement, except in cases where they refuse further sharing or operation of this “Avant2Go” electric vehicle as described below.
7.2. The Service Provider enables the User to share an “Avant2Go” electric vehicle with the following characteristics:
Usually clean and undamaged, except for possible minor damages or deficiencies that do not affect the ability to operate the “Avant2Go” electric vehicle or driving safety, which are listed for the specific “Avant2Go” electric vehicle in the “Avant2Go” mobile application;
Technically sound;
Registered;
Insured with mandatory motor liability insurance and comprehensive motor insurance;
Equipped with a vehicle start key, with its tag placed in the reader located in the glove compartment;
Equipped with legally prescribed and safety equipment (reflective triangle, reflective vest, first aid kit, spare bulbs, winter equipment);
Equipped with additional equipment (battery charging cables stored in the vehicle’s trunk, as well as other equipment listed);
Provided with a list of the “Avant2Go” electric vehicle’s equipment, available in the “Avant2Go” mobile application;
Provided with vehicle documents, including: traffic permit and mandatory motor liability insurance policy.
7.3. The User is obliged to immediately inspect the vehicle (externally and internally) and review the vehicle documents upon picking up the “Avant2Go” electric vehicle. Later complaints will not be considered.
7.4. If the User notices damage, defects, or deficiencies or observes that the vehicle is obviously dirty (e.g., soiled, smells of tobacco or tobacco products, etc.), they must report it before starting to operate the vehicle, and no later than 10 (ten) minutes from the moment of first unlocking or picking up the “Avant2Go” electric vehicle, by notifying the “Avant2Go” Contact Center at the phone number 0800 80 562. The User must describe the vehicle’s condition in detail to the Contact Center employee and then follow the instructions provided.
In case of visible damage or deficiencies, or if the vehicle is excessively dirty, the User must photograph the condition and immediately send the photos to the Service Provider via the “Avant2Go” mobile application.
The “Avant2Go” Contact Center employee may:
Terminate further sharing of the vehicle in case of damage, defects, or deficiencies to the “Avant2Go” electric vehicle that could affect its drivability or driving safety or passenger safety;
Approve further sharing of the vehicle in case of minor damages that do not affect the drivability of the “Avant2Go” electric vehicle or driving safety or passenger safety, and when the vehicle is obviously dirty, in which case the User has the right to refuse further sharing of the vehicle.
In case of refusal of further sharing, as per the previous paragraph, the User is exempt from payment obligations to the Service Provider for the refused sharing of the “Avant2Go” electric vehicle. If the User has already paid the sharing fee, they are entitled to a refund of the paid amount. To request a refund, the User must submit a refund request via email (or through the “Avant2Go” mobile application if such an option is available) within 8 (eight) days from the payment date. Generally, the User receives the refunded amount to the same payment method used for the payment. If the mobile application supports this option, the User may choose to receive the refund as credit in the “Avant2Go” mobile wallet instead of a refund to the payment method used.
The User may, either independently or at their request through the “Avant2Go” Contact Center employee, immediately reserve and pick up another available “Avant2Go” electric vehicle at an appropriate distance.
The Service Provider is not liable to the User in any case for any consequences, damages, or compensation in any way due to the refusal of further sharing of the “Avant2Go” electric vehicle.
7.5. If the User does not notify the “Avant2Go” Contact Center of possible damage, defects, or deficiencies or obvious dirt on the “Avant2Go” electric vehicle, it is deemed that the User has explicitly declared that:
They have carefully inspected the “Avant2Go” electric vehicle beforehand and are fully aware of its factual (usability and possible vehicle damage) and legal characteristics (vehicle documents);
The “Avant2Go” electric vehicle is in a condition for usual and normal use for sharing and operation (standardly clean, equipped with legally prescribed and additional equipment, and all vehicle documents);
The “Avant2Go” electric vehicle meets the purpose for which it is intended to be used;
They have no claims or complaints against the Service Provider on this basis and accept full responsibility and assume all risks related to the “Avant2Go” electric vehicle, its equipment, and vehicle documents, including the risk of destruction, damage, loss, seizure, and use exceeding normal usage, as per the terms of these General Terms, as well as liability towards third parties, from the moment the “Avant2Go” electric vehicle is picked up for sharing until its return.
8. DURATION OF SHARING AND SHARING FEE FOR THE ELECTRIC VEHICLE “Avant2Go”
8.1. The duration of sharing the “Avant2Go” electric vehicle is the time from the start of sharing to the end of sharing and return of the “Avant2Go” electric vehicle, calculated in minutes. During the sharing period, the User must not leave the “Avant2Go” electric vehicle unlocked or open (windows, doors, trunk). The User undertakes to immediately notify the “Avant2Go” Contact Center at 0800 80 562 of any possible error, deficiency, or damage to the “Avant2Go” electric vehicle that may occur during sharing and to act in accordance with the instructions provided.
8.2. The continuous duration of sharing the “Avant2Go” electric vehicle is limited to a maximum of 72 hours (4,320 minutes), unless otherwise explicitly agreed between the User and the Service Provider. If the User does not complete the sharing within the specified period or does not notify the “Avant2Go” Contact Center at 0800 80 562 in advance of exceeding the duration, it is deemed that after the expiration of 72 hours (except in case of a prior explicit agreement, as stated above) of uninterrupted sharing, the Service Provider unilaterally terminates the Distance Sharing Agreement, and the User acknowledges the Service Provider’s right to repossess the “Avant2Go” electric vehicle from the User.
During the sharing period, the number of kilometers traveled is recorded by a factory-installed and sealed odometer, which the Service Provider reads remotely (via GPS).
8.3. The fee for sharing the “Avant2Go” electric vehicle is calculated in accordance with the Membership Agreement and the amount specified in the Service Provider’s applicable “Avant2Go” Price List and consists of:
The tariff, calculated based on the sharing time, i.e., the entire duration of sharing, regardless of the number of kilometers traveled, whereby the initial minute lasting less than 60 seconds is counted as a minute; and
The mileage, calculated based on the kilometers traveled during the sharing period, whereby the initial kilometer shorter than 1,000 meters is counted as a kilometer.
When the User reaches the highest daily sharing price with the sum of the time spent and kilometers traveled, which are included in the daily sharing price according to the Price List, this price applies for 24 hours from the start of sharing. After 24 hours, the next day of use within the same sharing period starts again with the sum of kilometers traveled, which, according to the Price List, are included in the daily sharing price, and the time spent, until the highest daily sharing price is reached again.
If, according to the Price List, a kilometer limit applies to the vehicle for the daily sharing price, and the User exceeds this number of kilometers within 24 hours from the start of sharing, each additional kilometer traveled within the same 24 hours will be additionally charged. The calculation will be made in accordance with the applicable Price List.
8.4. The User may pay the fee using credit from the so-called electronic wallet in the “Avant2Go” mobile application, which can be obtained by purchasing a package or depositing funds into the wallet, or by directly paying after completing the sharing. The validity period of the credit obtained by purchasing a package or depositing funds into the wallet is 3 (three) years from the date of purchase/deposit.
At the User’s request, the Service Provider will refund the paid amount for the package or funds deposited into the wallet only upon termination of the contractual relationship and after settling all possible obligations to the Service Provider. In the case of purchasing the first package upon registration, the User is refunded the unused portion of the paid funds, reduced by the registration fee amount, if included in the package. For requests to refund the second or any subsequent purchased package or funds deposited into the wallet, the Service Provider refunds the entire unused portion of the paid funds. If the User purchases a package that includes additional gifted funds, the User is entitled to a refund of the unused portion of the paid funds, reduced by the amount proportional to the used portion of the gifted funds (which are always used first). If the User has completed fewer than 3 (three) sharings before requesting a refund, the Service Provider may charge a processing fee for the refund, as per the Price List.
8.5. The User is obliged to verify the accuracy of the data on each invoice issued by the Service Provider and to submit any objections regarding the invoice to the email address support@avant2go.mk no later than 8 (eight) days from the date of receipt of the invoice. Objections submitted after the expiration of the 8-day period will not be considered by the Service Provider.
9. ELECTRIC ENERGY, ELECTRIC BATTERY, AND CHARGING
9.1. The electric energy at “Avant2Go” charging stations is included in the sharing fee for the “Avant2Go” electric vehicle. The Service Provider is not responsible for the costs of charging the electric battery at non-“Avant2Go” charging stations. When charging “Avant2Go” electric vehicles at non-“Avant2Go” charging stations due to the User’s choice or fault, additional costs may arise after a certain period, depending on the charging station operator (e.g., costs if the vehicle remains connected to the charging station after charging is complete, and the operator charges for this). In such cases, the Service Provider reserves the right to charge the User these costs, along with other Service Provider fees, in accordance with the Price List.
9.2. The User picks up the electric vehicle, in principle, with the battery level as displayed before the reservation or when selecting the “Avant2Go” electric vehicle in the mobile application (APP).
9.3. The User is obliged to monitor the battery level and, during the sharing of the “Avant2Go” electric vehicle, ensure a sufficient battery level to complete the planned route, and, if necessary, charge the electric battery at “Avant2Go” charging stations during the journey.
9.4. Upon completing the sharing, the User, at their discretion, connects the electric vehicle to a charging station if there is an available charging station at the selected Location. If the electric battery’s energy level is less than 30% and the Location has an available charging station, the Service Provider recommends that the User act carefully and connect the vehicle to the “Avant2Go” charging station.
9.5. When connecting the electric battery to a charging station, the User must pay particular attention to properly connecting the cable and consider the restrictions on using the electric energy charging station, and above all, be aware that:
It is not safe to use the charging infrastructure during weather conditions that could negatively affect the charging station (e.g., risk of lightning strikes);
The charging infrastructure and charging cable must not be touched with wet hands;
Charging stations must not be used by persons under 21 years of age;
To prevent electric shock during battery charging, the plug is locked in the “Avant2Go” electric vehicle, and the User must not attempt to forcibly remove it;
A User with an implanted pacemaker must not:
Approach closer than 80 centimeters to the rear of the charging station, or
Approach closer than 80 centimeters to the front of the charging station during battery charging.
9.6. The User is liable to the Service Provider for any damage caused to the “Avant2Go” electric vehicle or the charging station or “Avant2Go” charging infrastructure due to improper use of the charging station or improper handling during electric energy supply.
10. PERMITTED AREAS, PARKING, AND “Avant2Go” LOCATIONS
10.1. In principle, the User picks up the “Avant2Go” electric vehicle for sharing from an “Avant2Go” Location.
10.2. The User must not cross the border of the Republic of North Macedonia with the “Avant2Go” electric vehicle, except in case of a prior agreement with the Service Provider.
10.3. The User is obliged to return the vehicle from sharing to the designated places for this purpose at an “Avant2Go” Location; otherwise, they will be charged a fee for locating and returning an improperly parked “Avant2Go” electric vehicle (this applies, among other things, to parking in spaces not intended for parking, such as parking in spaces for persons with disabilities or parking in spaces designated for charging vehicles on public infrastructure when the vehicle is not being charged, etc.), and, if necessary, a towing fee for the “Avant2Go” electric vehicle (e.g., due to a depleted battery), all in accordance with the Price List.
10.4. Leaving or parking the “Avant2Go” electric vehicle during the sharing period is permitted only in designated places for this purpose (public and private parking lots) and in the prescribed manner, in accordance with the parking conditions of the specific parking lot (e.g., time restrictions, payment of parking fees).
10.5. “Avant2Go” Locations are places designated exclusively for:
Picking up the “Avant2Go” electric vehicle for sharing;
Charging the electric battery of the “Avant2Go” electric vehicle;
Returning the “Avant2Go” electric vehicle from sharing.
10.6. The list of Locations is always available to the User in the “Avant2Go” mobile application.
11. RETURNING THE “Avant2Go” ELECTRIC VEHICLE AND COMPLETING THE SHARING
11.1. The User undertakes to return the “Avant2Go” electric vehicle, which they have taken based on the Membership Agreement or the Distance Sharing Agreement concluded based on it, together with the vehicle documents and equipment, to the designated place where returning the vehicle from sharing is permitted (Location).
11.2. The User undertakes to return the vehicle in an appropriate condition, considering its normal use, technically sound, with an appropriate electric battery level, in compliance with provision 9.4 of these General Terms, without third-party items, and fully prepared for normal use.
11.3. The User may return the “Avant2Go” electric vehicle when the following conditions are cumulatively met:
The vehicle start key is placed in the glove compartment, with the tag containing the built-in transmitter inserted into the reader’s slot located in the glove compartment;
The electric vehicle is parked at an “Avant2Go” Location, whereby the Service Provider recommends that the User connect the vehicle to a charging station if the electric battery level is below 30%;
All windows and doors of the “Avant2Go” electric vehicle are closed, and all lights and turn signals are turned off;
All charging cables are in the vehicle (the number of charging cables for each vehicle is specified in the APP).
11.4. The User completes the sharing of the “Avant2Go” electric vehicle as follows:
In the “Avant2Go” mobile application, selects the “Lock Vehicle” field and physically checks (by pulling the doors) whether the vehicle is indeed locked;
In the APP, confirms all required fields (closed doors, turned-off lights, cables in the vehicle, mandatory equipment, etc.);
After locking the vehicle and confirming all fields in the APP, selects the “End Sharing” field. Upon making this selection, the User is charged the sharing fees;
The User pays the sharing fee.
Until all the above steps are fully completed, the sharing is considered ongoing, and any additional fees for sharing the “Avant2Go” electric vehicle that has not been returned properly will be additionally charged to the User.
11.5. If it is not possible to complete the sharing due to the loss of the mobile phone, disruptions in the User’s mobile network operator, or issues with the APP’s functionality, the User must notify the “Avant2Go” Contact Center at 0800 80 562 or via email at support@avant2go.mk as soon as possible, and no later than 30 minutes from the moment they intended to complete the sharing. In this case, the end of sharing will be considered the moment confirmed by the “Avant2Go” Contact Center employee.
11.6. If the User forgets to complete the sharing, the Service Provider may, at the User’s request, complete it. In this case, the User may be granted the option to complete the sharing at the time they brought the vehicle to the final location, for which the Service Provider charges the User a fee for completing the sharing, as per the Price List.
12. REPOSSESSION OF THE “Avant2Go” ELECTRIC VEHICLE
12.1. The Service Provider may repossess the “Avant2Go” electric vehicle from the User during the sharing period in the following cases:
When the User exceeds the maximum permitted sharing duration (72 hours) and has not notified the “Avant2Go” Contact Center of the overrun before the permitted duration expires and has not obtained the Service Provider’s consent to extend the sharing; or
The User crosses the border of the Republic of North Macedonia with the “Avant2Go” electric vehicle, except in case of a prior agreement with the Service Provider; or
The User’s driver’s license has been temporarily revoked, a misdemeanor sanction prohibiting vehicle operation has been imposed, a misdemeanor sanction terminating the validity of the driver’s license has been imposed, or the driver’s license has expired; or
The Membership Agreement has been terminated, regardless of the reason; or
This is necessary to protect the Service Provider’s property and legal interests.
12.2. Repossession of the “Avant2Go” electric vehicle may be carried out:
In cooperation with the User, whereby the User, immediately upon being requested by a “Avant2Go” Contact Center employee via phone, returns the “Avant2Go” electric vehicle and completes the sharing in accordance with the Contractual Documentation;
Without the User’s cooperation by:
Blocking the starting and operation of the “Avant2Go” electric vehicle;
Reporting the misappropriation of the “Avant2Go” electric vehicle to the competent police station; and
Taking possession of the “Avant2Go” electric vehicle.
12.3. In all cases listed in point 12.1 of these General Terms, the User explicitly and unconditionally acknowledges the Service Provider’s right to immediately repossess the “Avant2Go” electric vehicle in any of the ways described above and explicitly and unconditionally permits the Service Provider to repossess the “Avant2Go” electric vehicle to protect the Service Provider’s property.
12.4. The User is liable to the Service Provider for all costs of taking possession of the “Avant2Go” electric vehicle, for the incurred and determined material damage (ordinary damage) and lost profit.
13. INSPECTION OF THE “Avant2Go” ELECTRIC VEHICLE UPON RETURN OR REPOSSESSION
13.1. If the Service Provider, upon taking possession of the vehicle, determines that the condition of the returned “Avant2Go” electric vehicle is not appropriate (cleanliness, battery level, obvious damage, tobacco odor, etc.) or that the User has used it contrary to the provisions of the Membership Agreement and other Contractual Documentation, the Service Provider has the right to conduct necessary inspections and repairs and perform other actions at the User’s expense to restore the “Avant2Go” electric vehicle to its original condition.
13.2. “Avant2Go” electric vehicles may be equipped with a damage detection system and/or a smoke detection system (e.g., from smoking). The damage detection system enables the Service Provider to automatically detect vehicle damage with high precision, including the exact time, place, and location of the damage. The smoke detection system enables automatic detection of smoke in the vehicle with high precision, including the exact time of the event. Data obtained through the damage and/or smoke detection system will be verified by the Service Provider through a physical inspection of the vehicle. Based on the system’s report and after the event is confirmed by a physical inspection of the vehicle (damage/smoke), the Service Provider will identify the specific User who used the sharing service at the time of the detected unauthorized action.
13.3. If the User does not return all received vehicle-related documents or the vehicle’s equipment or accessories, they are obliged to compensate the Service Provider for all costs of their replacement.
13.4. Vital vehicle components are sealed or marked with factory numbers. If the Service Provider determines that a component is missing or replaced, they have the right to charge the User for the entire incurred damage.
13.5. The Service Provider has the right to claim compensation from the User if the User intentionally or through gross negligence fails to take necessary actions to eliminate the vehicle’s legal, technical, or economic unusability or reduced usability.
13.6. In the cases mentioned in the previous paragraphs, the User is obliged to compensate the Service Provider for all obligations related to costs and other fees in accordance with the applicable Price List, including the obligation to compensate for the entire incurred damage, including any lost profit for the period when the “Avant2Go” electric vehicle could not be used for providing the “Avant2Go” service, whereby the lost profit for each day the vehicle was unavailable is calculated based on the daily sharing price for such a vehicle according to the applicable Price List.
13.7. Considering the provisions of points 5.3 and 11.4 of these General Terms, the User is obliged to immediately remove all personal items or items of their passengers from the vehicle upon completing each sharing. The Service Provider assumes no responsibility for items left by the User or a third party in or on the “Avant2Go” electric vehicle or in any replacement vehicle after completing the sharing, regardless of whether the sharing ended through regular return or repossession of the vehicle in any of the ways described above, nor for items left by the User or a third party at the Service Provider’s premises. The User is solely responsible for the loss, damage, and/or destruction of their own items and those of third parties. Regardless of the circumstances, the Service Provider does not offer storage for items left in the “Avant2Go” vehicle, and the User must immediately retrieve them or authorize another person in writing to retrieve them. If a large quantity of items remains in the “Avant2Go” vehicle, the Service Provider reserves the right to dispose of the items if they are not retrieved by the User after being notified, and the Service Provider is not liable for any possible damage or other consequences incurred by the User as a result. The Service Provider stores small forgotten items in the “Avant2Go” vehicle at its premises for a limited period (up to 30 days).
14. DEFECT OF THE “Avant2Go” ELECTRIC VEHICLE
14.1. In case of a defect, the User is obliged to immediately notify the “Avant2Go” Contact Center at 0800 80 562 and act in accordance with the instructions provided.
14.2. If the User acts contrary to the provisions of this point, repairs the “Avant2Go” electric vehicle on their own, or if a defect occurs due to improper use or operation by the User, the costs of defect removal or repair are borne by the User, who is also obliged to compensate the Service Provider for all legally recognized damage resulting from such actions.
15. INTERVENTIONS ON THE “Avant2Go” ELECTRIC VEHICLE
15.1. It is prohibited to make any changes, modifications, installations, or other interventions on the “Avant2Go” electric vehicle.
15.2. The User is explicitly prohibited from making any changes or interventions on the odometers/meters and the vehicle’s electronic or electrical equipment.
15.3. If the User acts contrary to the provisions of this point, the User is obliged to compensate the Service Provider for the costs of restoring the vehicle to its original condition, as well as the entire material damage (ordinary damage) and lost profit for the period when the individual “Avant2Go” electric vehicle could not be used for providing the “Avant2Go” service, whereby the lost profit for each day the vehicle was unavailable is calculated based on the daily sharing price for such a vehicle according to the applicable Price List, incurred by the Service Provider as a result of the User’s actions.
16. USER’S OBLIGATIONS IN CASE OF DAMAGE
16.1. If the “Avant2Go” electric vehicle is damaged (regardless of the extent of the damage), destroyed, seized, or stolen, or if the vehicle is involved in a traffic or other accident (in case of damage) that may lead to a legal dispute between the Service Provider and the User or between the Service Provider and third parties, the User is obliged to immediately notify the “Avant2Go” Contact Center at 0800 80 562 during the sharing period, and no later than 1 (one) hour from the occurrence of the damaging event (final deadline), and act in accordance with further instructions. In case of theft or fire of the vehicle, the User must immediately, without delay, report the event to the police; in case of a traffic or other accident, the User must immediately, without delay, report the event to the police, except in cases of vehicle damage where the legal conditions for completing a European Accident Report are met. In all the above cases, the User must resubmit their driver’s license for inspection to the Service Provider upon request.
16.2. The User undertakes to protect the interests of the Service Provider and its insurance company in case the “Avant2Go” electric vehicle is involved in any traffic or other accident, or in case of damage to/with the “Avant2Go” electric vehicle, by:
Recording the names and addresses of all involved participants and witnesses to the accident, as well as the registration numbers of the involved vehicles;
Providing first aid to any injured persons;
Not abandoning the damaged vehicle until it is secured or moved to a safe location;
Not admitting fault to third parties;
In all cases, immediately calling the police, informing them of the accident, awaiting their arrival and the preparation of the relevant official accident report, and obtaining a copy of said report, whereby the User undertakes to provide the police with accurate and truthful information about the circumstances, causes, and consequences of the event;
Thoroughly completing the European Accident Report, drawing a sketch, and providing their truthful statement, which they will immediately submit to the Service Provider.
16.3. In case of a damaging event, regardless of whether it involves partial damage or complete destruction or loss of the vehicle, the User is obliged to preserve all evidence of the event and obtain documentation of the damaging event necessary for filing a damage claim.
For untimely or non-fulfillment of the obligations in this point, the User is obliged to compensate the Service Provider for the damage, and the Service Provider may also request early termination of the Membership Agreement with the User, with all consequences arising from early termination due to the User’s fault.
16.4. If the paid compensation or insurance premium paid by the insurance company is insufficient to cover the entire damage, or if the insurance company refuses to pay the premium or compensation for reasons not attributable to the Service Provider, the User is obliged to compensate the Service Provider for the difference up to the full amount of the damage, including material damage (ordinary damage) and lost profit for the period when the individual “Avant2Go” electric vehicle could not be used for providing the “Avant2Go” service, whereby the lost profit for each day the vehicle was unavailable is calculated based on the daily sharing price for such a vehicle according to the applicable Price List. In cases where the insurance company determines that the full responsibility for the damage lies with the User, the insurance company has the right to seek recourse directly from the User.
16.5. In case of confirmed damage caused by the User, the Service Provider has the right to charge the User processing fees for handling the damage case, in accordance with the Price List.
17. INSURANCE COVERAGE AND DAMAGE
17.1. Each individual “Avant2Go” electric vehicle is insured in accordance with the applicable regulations of the Republic of North Macedonia and the general terms of the insurance company, as evident from the insurance policy for each individual “Avant2Go” electric vehicle, available for inspection in original at the Service Provider, and to the extent agreed in the Membership Agreement (conclusion of comprehensive motor insurance, User’s liability for vehicle-related damage in the amount specified in the Price List).
17.2. Regardless of the concluded insurance policy for the individual “Avant2Go” electric vehicle, the User is obliged to compensate the Service Provider for any potential damage to the individual electric vehicle and/or equipment, including lost profit and costs specified in the applicable Price List, in the following cases:
If the “Avant2Go” electric vehicle is insured with comprehensive motor insurance, the User bears liability for vehicle-related damage in accordance with point 17.3;
If there is damage to the vehicle’s interior, tires, wheels, hubcaps, windshield wipers, antenna, lighting devices, glass surfaces, vehicle undercarriage, clutch damage or wear, brake disc overheating, siren destruction, chassis optics imbalance, chassis damage, and other vehicle or component damages not covered by the insurance company;
If the User caused the damage under the influence of alcohol (in accordance with applicable legal regulations), drugs, or psychotropic substances (sedatives, hypnotic drugs, other medications, or other psychoactive substances) known to prohibit or advise against driving;
If the User caused the damage intentionally or through gross negligence;
If the User did not have a valid driver’s license or was prohibited from operating a vehicle at the time of the damage;
If the damage occurred outside the territory of the Republic of North Macedonia, regardless of the User’s fault;
If the damage occurred due to other violations of the provisions of point 5 (restrictions on sharing the “Avant2Go” electric vehicle) or due to use of the vehicle contrary to the provisions of the Contractual Documentation;
If the User fled the scene of the accident, regardless of fault;
In other cases not covered by the insurance company or exceeding the insurance coverage limit, regardless of the User’s fault;
In case of an unsuccessful legal dispute against third parties, including the entire damage, costs, and fees.
17.3. The User is obliged to compensate the Service Provider for damage caused by third parties during the period when the User bears the risks associated with the “Avant2Go” electric vehicle and/or its use, regardless of fault, whereby the above provisions apply accordingly. The User also fully covers third-party damage claims not covered by the insurance company. If the User is responsible for vehicle damage covered by the insurance company, the User is, in any case, liable to the Service Provider for vehicle damage in the amount specified in the applicable Price List.
17.4. The “Avant2Go” electric vehicle is insured only for the duration of the Membership Agreement. After the expiration of the Membership Agreement, the Service Provider is not liable for traffic accidents or other damage, loss, or destruction of the vehicle, which are considered the User’s personal responsibility, whereby the User is obliged to compensate for the entire potential damage, regardless of the vehicle’s current insurance.
17.5. Only the Service Provider has the right to file a damage claim in case of damage. If the premium/damage compensation is insufficient to cover the entire material damage and any lost profit incurred by the Service Provider, the User is obliged to compensate the Service Provider for the entire such damage within 8 (eight) days from the date of the Service Provider’s written request sent via email to the User’s email address. In cases where the insurance company determines that the full responsibility for the damage lies with the User, the insurance company has the right to seek recourse directly from the User.
18. COMPLIANCE WITH TRAFFIC REGULATIONS
18.1. The User is responsible and assumes all obligations arising from non-compliance with traffic regulations, improper parking, or other violations of legal regulations during the sharing of the “Avant2Go” electric vehicle, and for all damage caused by the same.
18.2. The User undertakes to pay all potential fines, penalties, and other sanctions for committed offenses with the “Avant2Go” electric vehicle during the sharing period independently, without the Service Provider’s intervention, and if this is not possible, to compensate the Service Provider for all amounts and related costs owed to them if the Service Provider makes the payment on the User’s behalf. This User responsibility continues even after the expiration of the Membership Agreement or Distance Sharing Agreement if such fines or penalties arise from the period when the User was sharing the “Avant2Go” electric vehicle.
19. USE OF ELECTRONIC SIGNATURE FOR SIGNING THE AGREEMENT
19.1. The User has the option to electronically sign the Membership Agreement using an electronic signature, whereby, by selecting this option, the User:
Consents to using an electronic document and electronic signature, confirming that they fully understand that the electronic signature and electronic document have the same legal force as a printed document and handwritten signature;
Confirms that they have read the electronic document (Membership Agreement) and the data subject to electronic signing;
Receives an email at their email address with instructions for electronically signing the Membership Agreement and follows the provided instructions. The User consents that the unique code received via SMS on their mobile phone will be used as their electronic signature, whereby they electronically sign the Membership Agreement and acknowledge, accept, and undertake that such signing represents an expression of their will to enter into a contractual relationship and assume the obligations arising from the Membership Agreement concluded between them and the Service Provider for using the “Avant2Go” electric vehicle sharing services;
After signing, the system sends an email to the User’s email address as confirmation of the signed Membership Agreement, whereby the User receives a copy of the signed Membership Agreement (electronic document). The storage and sharing of the electronic document is the User’s responsibility and right. The email address to which the confirmation and copy of the Membership Agreement are sent is verified by the User in the “Avant2Go” system;
The electronic signing of the Membership Agreement complies with the applicable Law on Electronic Documents, Electronic Identification, and Trust Services and other applicable legal regulations;
The electronic signing of the Membership Agreement is used exclusively for regulating contractual relations between the User and the Service Provider regarding the use of “Avant2Go” electric vehicle sharing services;
The data used for electronic signing comply with the Law on Personal Data Protection;
The Membership Agreement is signed in PDF format, which ensures advanced and secure authentication and precise forensic examination, if needed, to prove the document’s authenticity.
20. WITHDRAWAL FROM THE AGREEMENT
The User has the right to withdraw, without a notice period, only from the Membership Agreement concluded remotely or outside the Service Provider’s business premises, in accordance with the following provisions:
20.1. The User has the right to withdraw from the Membership Agreement within 14 days without providing a reason or explanation for the withdrawal, if the agreement was concluded remotely (signed with an electronic signature remotely) or outside the Service Provider’s business premises, in accordance with the provisions of the applicable Law on Consumer Protection. The withdrawal period expires 14 days from the date of concluding the Membership Agreement.
20.2. To exercise their right of withdrawal, the User must notify the Service Provider (AVANT CAR DOO Skopje, ul. 11-ti Oktomvri br. 2 Centar, Skopje, email: support@avant2go.mk, phone: 0800 80 562) of their decision to withdraw from the Membership Agreement with an unequivocal statement via email to the above email address or in written form via registered mail to the above address of the Service Provider’s headquarters.
20.3. For timely withdrawal from the Membership Agreement, it is sufficient for the User to send the withdrawal notice to the Service Provider in one of the above ways before the 14-day withdrawal period expires.
20.4. If the User withdraws from the Membership Agreement, the Service Provider will refund all payments made by the User without delay, and in any case no later than 14 days from the date of receiving the withdrawal notice. The Service Provider will make the refund using the same payment method used by the User for payment, unless the User explicitly agrees otherwise. The User will not incur any costs or fees related to such a refund.
20.5. Notwithstanding point 19.4, the User is not entitled to a refund of the one-time registration fee. If the User has started using the “Avant2Go” electric vehicle sharing service during the withdrawal period, the User is obliged to pay the Service Provider the fee for the services provided.
20.6. The User cannot withdraw from the Membership Agreement in cases where the Service Provider has fully performed the agreement and started providing the service to the User, but only if the performance began with the User’s prior explicit consent, which also confirms that by the Service Provider’s performance of the Membership Agreement, the User will lose the right to withdraw from the Membership Agreement.
20.7. The User cannot withdraw from individual Distance Sharing Agreements, except in the cases and manner specified in point 7 of these General Terms.
21. REFERRAL PROGRAM RULES: REFER AND GET BENEFITS
21.1. Within the Referral Program: Refer and Get Benefits, the Service Provider offers all existing Users with an active user profile (hereinafter: “Existing Member”) the opportunity to receive an additional benefit in the form of a voucher for sharing “Avant2Go” electric vehicles. This point of the General Terms establishes the specific conditions for participating in obtaining benefits and the rules for receiving benefits.
21.2. The Existing Member can obtain and use the benefit as follows:
In the “Avant2Go” mobile application, by clicking on the “Refer and Get a Discount” window, accessing their unique referral code;
By clicking the “Share” button, they send an invitation to desired individuals who are not yet registered in the “Avant2Go” system via the chosen method (SMS, email, or other direct message) with an indication of the benefit’s value (voucher) and a link to the unique referral code;
The person receiving the invitation and link to the unique referral code registers in the “Avant2Go” system, enters the received unique referral code during registration, purchases one of the available packages, signs the Membership Agreement, becomes a Member of “Avant2Go”, and can then complete their first sharing with an “Avant2Go” electric vehicle (hereinafter: “New Member”);
When the New Member completes their first sharing with an “Avant2Go” electric vehicle, both the Existing Member who provided the unique referral code and the New Member receive an email with a voucher statement and notification of the voucher’s activation, its value, usage method, and how to track the voucher’s status;
The received voucher can be used by the Member exclusively for sharing “Avant2Go” electric vehicles, whereby, during the vehicle reservation process in the APP, before clicking the “Reserve Vehicle” button, they activate the “Use Benefit” option, and the sharing payment is made using the voucher.
21.3. The Member can track the voucher’s status in the APP under the “Benefits” section, located under the “Wallet” icon, until the voucher’s full value is used or, if the voucher’s validity period is limited, until its expiration. The Member can use the voucher exclusively for sharing “Avant2Go” electric vehicles until its value is exhausted or, if the validity period is limited, until it expires. The voucher’s value and validity period are specified in the APP under the “Benefits” section.
21.4. During the referral program, the Existing Member can share their unique referral code with an unlimited number of people in the manner described above and, by meeting the above conditions, gain the opportunity to activate and use multiple vouchers.
21.5. The New Member, after completing their first ride with an “Avant2Go” electric vehicle, receives their own unique referral code in the APP, and thus the opportunity, after clicking the “Refer and Get Benefits” button and completing the procedure outlined in point 21.2, to receive a new benefit based on activating a new voucher.
21.6. The unique referral code is assigned to each Member who is a natural person, as well as to each User sharing “Avant2Go” electric vehicles based on a Membership Agreement signed with a legal entity. The latter, in case of sharing the unique referral code and activating a voucher based on the New Member’s first sharing, can use the voucher only if they signed the Membership Agreement as a natural person. After the New Member completes their first sharing, Members/Users can use the activated voucher only for private rides and exclusively for sharing “Avant2Go” electric vehicles.
21.7. The Service Provider reserves the right to modify, upgrade, or discontinue the implementation of the Referral Program: Refer and Get Benefits at any time or to resume its implementation under modified conditions, without affecting the already acquired rights of Members arising from voucher activation, as per the fourth bullet of point 21.2. Thus, in case of changes or discontinuation of the referral program, Members/Users who have already received an activated voucher up to the moment of the change/discontinuation can use such a voucher in accordance with the program’s conditions under which they obtained the benefit.
21.8. Members/Users can use the acquired activated voucher, in the amount issued, exclusively for sharings within the “Avant2Go” electric vehicle sharing service. Members/Users cannot exchange the voucher for another service of the “Avant2Go” system or any other service of the Service Provider.
21.9. Members/Users cannot request the voucher’s value to be paid out in cash or via bank transfer, nor can they use the voucher’s value to settle unpaid sharing fees for “Avant2Go” electric vehicles or other outstanding obligations that may be charged to the Member under the provisions of the Membership Agreement or these General Terms.
21.10. The benefits from the voucher cannot be transferred between “Avant2Go” user accounts, nor can the Member transfer the voucher’s benefits to their user account for sharing “Avant2Go” electric vehicles in other countries where the service is available.
21.11. Each Existing Member receives only one unique referral code, and thus the opportunity to receive a voucher based on sharing this unique referral code. If a Member activates one or more additional user profiles, the Service Provider reserves the right to prevent this Member from sharing the unique referral code or to disable the activation and use of the voucher on all additional user profiles.
21.12. An already acquired but unused voucher does not prevent the Service Provider from terminating the Membership Agreement in accordance with the provisions of the Membership Agreement and these General Terms. In case of termination of the Membership Agreement for any reason given by the Service Provider or the Member, the Member cannot request the payout of the voucher’s value.
21.13. The Service Provider is not liable to Members or Users for any damage caused as a result of participating in the referral program or accepting the benefits.
21.14. The referral program applies exclusively to the “Avant2Go” electric vehicle sharing service, and for all matters not explicitly regulated in this point of the General Terms, other provisions of these General Terms or the Contractual Documentation will apply. The referral program is valid only for using the “Avant2Go” electric vehicle sharing services in the territory of the Republic of North Macedonia.
22. OUT-OF-COURT RESOLUTION OF CONSUMER DISPUTES
22.1. The Service Provider complies with the applicable consumer protection legislation and makes maximum efforts to fulfill its obligation to establish an effective system for handling consumer complaints. Consumer complaints can be submitted via email to support@avant2go.mk or in writing to the address of the headquarters of AVANT CAR DOO Skopje, ul. 11-ti Oktomvri br. 2 Centar, Skopje. The Service Provider is obliged to respond to the User’s consumer complaint no later than 15 days from the date of receiving the complaint. The Service Provider handles the consumer complaint procedure in accordance with the provisions of the applicable Law on Consumer Protection.
23. FINAL PROVISIONS
23.1. These General Terms and other “Avant2Go” Contractual Documentation are prepared in the Macedonian language and apply to all Users. In case of the existence of versions of these General Terms and other Contractual Documentation in other languages, the Macedonian language version prevails for interpretation of the provisions. The Membership Agreement is valid in the language in which the Service Provider and the User concluded it.
23.2. These General Terms of the Service Provider take effect within 15 days (at 00:00) from the date of notification to the Member/User via email and publication on the website www.avant2go.mk. In case of amendments or supplements to the General Terms, Members/Users will be individually notified via email and on the website www.avant2go.mk, as well as of the effective date of the amendments and supplements and the rights they have in case of non-acceptance of the amendments and supplements.
23.3. Amendments and supplements to these General Terms take effect within 15 days (at 00:00) from their publication on the Service Provider’s website www.avant2go.mk and notification to the Member/User via email, whereby the provisions of these terms apply to regulate relations regarding the sharing of the “Avant2Go” electric vehicle started before the amendments and supplements take effect.
